51 c.p. viene utilizzato per mettere a fuoco, rispetto all’art.
Abstract [ENG]: Judgment no. 16186 of 2026 revisits the scope of the immunity provided for by Article 598 of the Italian Criminal Code and its relationship with the justification based on the exercise of the right of defence under Article 51 of the Criminal Code, read in the light of the constitutional guarantee enshrined in Article 24 of the Constitution. Following the main steps of the Court’s reasoning, the article first reconstructs the structural requirements of the immunity, with particular regard to the functional connection between the offensive statement, the subject matter of the proceedings and the defensive arguments advanced, highlighting that its application does not require the statement to be strictly necessary for the defence, nor does it depend on the truth of the allegation or on any particular degree of restraint in expression. Against this background, reference to certain situations falling within Article 51 is used to clarify, in relation to Article 598, both the different intensity of the applicable requirements and the different underlying interests they serve, distinguishing in particular the exercise of the right of defence under Article 24 of the Constitution from manifestations of freedom of expression under Article 21. The article then considers the formula, reiterated by the Court, according to which Articles 598 and 51 operate on “different legal planes”, and examines the extent to which their common rationale rooted in the protection of the right of defence can coexist with their different legal structure and requirements. Finally, the analysis addresses the interest of a defendant who has already been declared not punishable under Article 598 in seeking a different legal classification of the conduct under Article 51, with brief reference to the further civil-law and procedural implications mentioned in the judgment.
