Abstract [ITA]: La sentenza in rassegna offre un contributo di rilievo in tema di reati sessuali in danno di minori realizzati mediante strumenti telematici. Riconosciuta la piena configurabilità di tali illeciti anche “tra assenti” – in una prospettiva che la stessa Corte efficacemente ascrive a una emergente categoria di smart crimes – il Collegio chiarisce che, ai fini dell’integrazione del delitto di atti sessuali con minorenne (art. 609-quater c.p.), non è necessario verificare l’effettiva valenza induttiva della condotta dell’agente, essendo sufficiente un mero nesso di causalità tra questa e il comportamento del minore, che ne impone la sola posteriorità e non anche la contestualità; ciò a differenza della violenza sessuale in senso stretto (art. 609-bis c.p.), ove la forza costrittiva della minaccia deve perdurare sino al momento del fatto. La pronuncia ribadisce, altresì, che nel delitto di cessione di materiale pedopornografico (art. 600-ter, comma 4, c.p.) sono irrilevanti tanto la distinzione tra “cessione” e “consegna” quanto l’intento perseguito dall’agente, e che il requisito della “utilizzazione” del minore sussiste anche a fronte di immagini autoprodotte, ove la loro realizzazione sia frutto di una pressante sollecitazione ab alieno.
Abstract [ENG]: The decision of the Court of Cassation, Criminal Section III, 8 May 2026, no. 16564, makes a significant contribution regarding sexual offences against minors committed through electronic means. Having recognised that such offences can also be committed “between absent parties” – within a perspective that the Court itself aptly ascribes to an emerging category of “smart crimes”, the panel clarifies that, for the purposes of the offence of sexual acts with a minor (Article 609-quater of the Criminal Code), it is not necessary to ascertain the actual inducing effect of the offender’s conduct, since a mere causal link between the latter and the minor’s behaviour is sufficient, requiring only its subsequence and not its contemporaneity; this differs from sexual violence in the strict sense (Article 609-bis), where the coercive force of the threat must persist until the moment of the act. The ruling further reaffirms that, in the offence of transferring child pornography (Article 600-ter, paragraph 4), both the distinction between “transfer” and “delivery” and the offender’s purpose are irrelevant, and that the requirement of the “use” of the minor also exists in the case of self-produced images, where their creation is the result of pressing solicitation ab alieno.
