Abstract [ITA]: La presente nota si propone di esaminare una pronuncia della suprema Corte di Cassazione in tema di circostanze attenuanti comuni, con particolare riguardo alla provocazione. Viene approfondito il requisito del “fatto ingiusto altrui” e la sua necessaria oggettività, nonché i limiti applicativi dell’attenuante nei casi di condotta provocata dall’agente stesso e di sproporzione tra atto ingiusto e reazione.

Abstract [ENG]: This note aims to examine a recent ruling of the Supreme Court of Cassation concerning common mitigating circumstances, with particular reference to provocation. It focuses on the requirement of the “wrongful act of another” and its necessary objectivity, as well as the limits of the mitigating circumstance in cases where the conduct was provoked by the agent himself or where there is a disproportion between the wrongful act and the reaction.
