Abstract IT: Il contributo si propone di indagare l’impatto della Convenzione delle Nazioni Unite sui diritti delle persone con disabilità nell’ordinamento italiano, con specifico riferimento alla giurisprudenza della Corte costituzionale. Lo scritto, dopo aver offerto una disamina della Convenzione nel quadro dell’evoluzione della tutela internazionale dei diritti delle persone con disabilità (e, segnatamente, alla luce dell’affermazione del c.d. human rights model of disability), si sofferma sull’influenza esercitata dalla Convenzione sulla giurisprudenza costituzionale, ora come criterio interpretativo ausiliario ora come parametro interposto di legittimità costituzionale.
Abstract EN: The contribution aims to investigate the impact of the United Nations Convention on the rights of persons with disabilities in the Italian legal system, with specific reference to the jurisprudence of the Constitutional Court. The paper, after having offered an examination of the Convention in the context of the evolution of the international protection of the rights of people with disabilities (and, in particular, in light of the affirmation of the so-called human rights model of disability), focuses on the influence exerted by the Convention on constitutional jurisprudence, now as an auxiliary interpretative criterion, now as an interposed parameter of constitutional legitimacy.
