Abstract [ITA]: La nota analizza una recente pronuncia della Corte di cassazione in materia di omicidio volontario aggravato. La decisione in commento ha riconosciuto l’aggravante dei motivi abietti o futili ex art. 61, comma, 1 c.p. in relazione all’art. 577, comma 1, n. 4, c.p., nell’ipotesi in cui la gelosia costituisca espressione di uno spirito punitivo che abbia determinato la causa dell’azione omicidiaria. La pronuncia desta interesse in ragione delle precisazioni sviluppate dalla Corte con riguardo alla compatibilità tra la gelosia e la predetta aggravante.

Abstract [ENG]: This paper analyses a recent ruling by the Court of Cassation on aggravated voluntary homicide. The decision recognized the aggravating circumstance of despicable or futile motives pursuant to Article 61(1) of the Criminal Code in relation to Article 577(1) (4) of the Criminal Code, in cases where jealousy constitutes an expression of a punitive spirit that determined the cause of the murder. The ruling is of interest because of the clarifications made by the Supreme Court regarding the compatibility between jealousy and the existence of the aforementioned aggravating circumstance.
